Terms of Service

The Short Version

NanoComic lets you create comic pages using AI. You own what you create. Don't use it for anything illegal or harmful. Credits are non-refundable. We can terminate accounts that violate these terms.

Agreement to Terms

By accessing or using NanoComic ("the Service"), you agree to these Terms of Service ("Terms"). If you don't agree, don't use the Service.

These Terms are a legal agreement between you and OVERNERD LLC ("we", "us", "our"). We may update these Terms from time to time — continued use after changes means you accept the new Terms.

Eligibility

You must be at least 18 years old to use NanoComic. By using the Service, you represent that you meet this requirement.

Service Availability

NanoComic is only available in certain countries and territories. Access from unsupported regions is blocked. We may change supported regions at any time without notice.

Your Account

You need an account to use NanoComic. You're responsible for:

  • All activity under your account
  • Keeping your account secure
  • Notifying us promptly if you suspect unauthorized access

We may suspend or terminate accounts that violate these Terms.

The Service

NanoComic is an AI-powered tool for creating comic pages. You provide prompts and optional reference images, and our Service generates comic artwork using Google's Gemini AI.

Generation requests may be processed immediately or queued for batch processing depending on the mode you select. Batch processing offers reduced credit costs but may take longer to complete.

Credits are consumed when a generation request is processed, regardless of whether the output is delivered or blocked by content filters.

We may modify, suspend, or discontinue any part of the Service at any time without notice.

The Service is provided "as is." We don't guarantee that generations will meet your expectations, be error-free, or be available without interruption.

Credits and Payments

NanoComic uses a credit system. You purchase credits through Polar, our payment provider and merchant of record.

  • Trial credits: New accounts may receive a one-time grant of trial credits. Trial credits are subject to the same terms as purchased credits. We may modify or discontinue trial credit offers at any time.
  • Non-refundable: Credits are non-refundable except where required by law.
  • No expiration: Credits don't expire while your account is active.
  • Account deletion: Unused credits are forfeited when you delete your account.
  • Pricing changes: We may change pricing at any time. Changes apply to future purchases, not credits you've already bought.

For payment disputes, contact Polar directly as they are the merchant of record.

Your Content

"Your Content" means the prompts you write, reference images you upload, and any other material you provide to the Service.

You retain ownership of Your Content. By using the Service, you grant us a limited license to use Your Content solely to provide and improve the Service — including sending it to our AI providers for generation.

You represent that:

  • You have the right to use and share Your Content
  • Your Content doesn't infringe anyone else's rights
  • Your Content complies with these Terms and applicable law

Generated Content

"Generated Content" means the comic images the Service creates for you.

Ownership: You own the Generated Content you create using the Service, subject to any rights of third parties and the limitations below.

Limitations: AI-generated content may have legal uncertainties regarding copyright in some jurisdictions. We make no representations about the copyright status of Generated Content. You're responsible for how you use it.

Similar outputs: AI models may generate similar or identical outputs for different users with similar inputs. We don't guarantee that your Generated Content will be unique.

No endorsement: Generated Content doesn't represent our views. We're not responsible for its accuracy, quality, or appropriateness.

Acceptable Use

You agree to use NanoComic only for lawful purposes. You will not use the Service to:

Create prohibited content:

  • Child sexual abuse material (CSAM) or any sexualized content involving minors
  • Sexually explicit, pornographic, or adult content, whether realistic or stylized, including AI-generated nudity or sexual imagery
  • Graphic violence or gore
  • Non-consensual intimate imagery of real people
  • Content designed to harass, threaten, or harm specific individuals
  • Fraud, impersonation, or deceptive content intended to mislead others
  • Content that infringes copyrights, trademarks, or other intellectual property rights, including unauthorized depictions of characters, logos, or other protected material
  • Content that violates any applicable law

Abuse the Service:

  • Circumvent usage limits or access controls
  • Attempt to bypass, disable, or circumvent AI safety filters or content moderation systems
  • Reverse engineer, decompile, or extract our systems
  • Use automated tools to access the Service without permission
  • Resell, sublicense, or redistribute the Service
  • Interfere with or disrupt the Service

The Service uses Google's Gemini AI for image generation. Your use must also comply with Google's Generative AI Prohibited Use Policy.

We may remove content and terminate accounts that violate these rules, without notice or refund.

Intellectual Property

The Service — including our website, software, branding, and documentation — is owned by OVERNERD LLC and protected by intellectual property laws. These Terms don't grant you any rights to our intellectual property except the limited right to use the Service as intended.

Third-Party Services

The Service relies on third-party providers including Google (Gemini AI), Clerk (authentication), and Polar (payments). Your use of the Service is also subject to their terms and policies. We're not responsible for third-party services.

Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We don't warrant that:

  • The Service will meet your requirements
  • The Service will be uninterrupted, secure, or error-free
  • Generated Content will be accurate, appropriate, or fit for any purpose
  • Any defects will be corrected

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OVERNERD LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY FOR ANY CLAIMS UNDER THESE TERMS SHALL NOT EXCEED THE GREATER OF (I) $50 USD OR (II) THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

Some jurisdictions don't allow these limitations, so they may not apply to you.

Indemnification

You agree to indemnify and hold harmless OVERNERD LLC from any claims, damages, losses, or expenses (including legal fees) arising from:

  • Your use of the Service
  • Your Content or Generated Content
  • Your violation of these Terms
  • Your violation of any third-party rights

Termination

By you: You can stop using the Service and delete your account at any time.

By us: We may suspend or terminate your access at any time, for any reason, including violation of these Terms. We're not obligated to provide notice or refunds.

Effect: Upon termination, your right to use the Service ends immediately. Sections that should survive termination (like Limitation of Liability and Indemnification) will survive.

Governing Law

These Terms are governed by the laws of the State of Connecticut, United States, without regard to conflict of law principles. Any disputes will be resolved in the courts of Connecticut.

General

  • Entire agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and us.
  • Severability: If any provision is found unenforceable, the rest remains in effect.
  • No waiver: Our failure to enforce any right doesn't waive that right.
  • Assignment: You can't assign these Terms. We can assign them in connection with a merger or acquisition.
